My initial thoughts using the second pics would be AU... 1. Except that damage on the REV is very pronounced. It IS damage correct, and not staining? I really like the looks of the REV - nice and sharp. 2. The wear on the OBV on all the high points just looks too severe to me to make it over XF. Now...

The reverse on seated coins always looks a bit higher than the obverse because the obverse design is a little higher in relief thus wears first. So the coin is EF.

I personally wouldn't chance it . I give it a MS-65 as well . I see No trace of wear except a few surface mars . Full luster. On the reverse I see 2 small "die cracks" at the top of the coin . One is across "States" and the other one across the Eagles left wing .

Unless this just came out of a collection off the market for 40yrs I would leave it be...almost any under-graded early slabs have already been resubmitted and the ones left are already spot on.. looking at the coin in my armchair opinion it might get a 65+ in reconsideration if the grader feels gene...

You pay them no matter what they do with your perceived error, there's not refund of any fees. You take the chance of sending a mint error and you must submit it under their mint error tier and that is more expensive than a regular submission. Grading companies don't look for errors for your for not...
